One Direction Sued By Californian Rock Band Of The Same Name

X-Factor boyband One Direction have been stuck in the clouds recently, with their short career exploding with success since the start of 2012 – with the group cracking both the US and Australia whilst keeping their UK fans as loyal as ever. But, they have hit a minor bump in the road – after a Californian rock group revealed that it was going to sue the boys for trademark infringement, as they share the One Direction name.

The lawsuit was filed on Monday and MusicWeek reports that it asks for a payment of $1million in damages – as well as 'three times the profits' made by One Direction. The band claim they've been using the name since 2009, and tried to trademark the name in February 2011, after they put out two albums. The lawsuit claims that Simon Cowell and his Syco group 'chose to ignore the plaintiff's rights and wilfully infringed them' when they made it aware that they both shared a name.

Whilst the 'What Makes You Beautiful' singers are probably not affected by the multiple use of the name in any way at all, the Californian rockers have claimed that the name has caused 'substantial confusion and substantial damage' to them. The band currently perform shows at local pubs and clubs.
