Paramore Face Legal Action Over Supposed Copyright Infringement

Pop-rockers Paramore are being sued by Florida band Tenspoke Indies who claim that the band ripped off part of their song
The relatively unknown Florida band Tenspoke Indies claim that part of their song ‘Starlighter’ has been taken and used in Paramore's hit ‘The Only Exception’.
The suit has been filed in U.S. District Court in Pennsylvania, claiming that in 2006 Tenspoke Indies sent a copy of the song to Paramore's record label Fueled By Ramen. The band were looking for representation from the label and hoping to join their catalogue of rock artists, which also includes the likes of Gym Class Heroes and Panic At The Disco.
‘The Only Exception’ was featured on their third studio album, ‘Brand New Eyes’, which was released in September 2009. By this time, Tenspoke Indies had already performed "Starlighter" in concert numerous times. The track was featured on their earlier album release, "Blinded By Sound".
Tenspoke Indies claim that there is substantial similarity between the two songs:“...including but not limited to, similarities in the introductions, arrangements, the chord progression, the key, the melody, the lyrical theme, the rhythm and tempo of both songs.”
Because of the similarities in the songs and because Paramore’s supposed failure to credit Tenspoke Indies for the song, they are suing for copyright infringement. The band have requested at least $75,000 in recognition for their work.
